These Terms & Conditions (“Terms”) govern every order placed with Gracious Nubian (Pty) Ltd, registration number 2015/173551/07 (“Gracious Nubian”, “we”, “us”, “our”). By placing an order with us — online, by EFT, or in person — you agree to these Terms. Please read them alongside our Return & Exchange Policy, which covers returns and exchanges in more detail.
1. Our Products
We offer two types of products, which are treated differently under these Terms:
- Ready-to-ship stock items: Reusable Sanitary Pads and Satin Pillowcases.
- Made-to-order items: Medical Uniforms & Linen, including scrub suits, produced to your specifications.
2. Quotes, Orders & Pricing
All prices are quoted in South African Rand (ZAR) and are only confirmed once issued to you in writing (via quotation or invoice).
An order is only confirmed once we have received it in writing and full payment has reflected in our account. We do not commence production or reserve stock on the basis of a verbal agreement alone.
3. Payment
We accept the following payment methods:
- EFT / bank transfer
- Card payments via Yoco
Full payment is required before an order is scheduled for production or dispatch. Banking details are provided on your invoice — please always confirm banking details directly with us telephonically before paying if you have any doubt, as we are not responsible for payments made to fraudulent or incorrect accounts.
4. Production & Dispatch Times
Reusable Sanitary Pads & Satin Pillowcases
These are kept in stock and are prepared and ready for shipping within 5 working days of proof of payment being received.
Medical Uniforms & Linen
These are made to order. Please allow 21 working days from receipt of proof of payment for production. Large-volume or custom orders may require additional time, which we will confirm at the time of quotation.
Production and dispatch timelines are estimates given in good faith. While we make every effort to meet them, Gracious Nubian is not liable for delays caused by couriers, suppliers, loadshedding, or other circumstances beyond our reasonable control. We will keep you informed of any delay as soon as we become aware of it.
5. Custom Sizing & Specifications
For Medical Uniforms & Linen ordered to custom measurements, it is the customer’s responsibility to provide accurate sizing information at the time of order. Gracious Nubian manufactures according to the measurements and specifications provided, and is not liable for an incorrect fit resulting from inaccurate information supplied by the customer.
6. Cancellations
Orders for ready-to-ship stock items (Reusable Sanitary Pads and Satin Pillowcases) may be cancelled for a full refund at any time before dispatch.
Because Medical Uniforms & Linen are made to order, once production has commenced these orders cannot be cancelled or refunded. Cancellation requests received before production has commenced will be assessed on a case-by-case basis and may be subject to a cancellation fee to cover costs already incurred.
7. Shipping & Delivery
Standard retail orders are shipped within South Africa. Export orders are available for our B2B and bulk-volume customers — please contact us to confirm shipping options, lead times and costs for orders outside South Africa.
Risk in the goods passes to you on delivery to the address you provided when ordering. Please check that your delivery address and contact details are correct before placing your order, as we are not responsible for orders delayed or lost due to incorrect information supplied by the customer.
8. Returns, Exchanges & Faulty Items
Returns and exchanges are governed by our Return & Exchange Policy. In summary:
- Reusable Sanitary Pads: no returns or exchanges once the packaging has been opened, for health and hygiene reasons.
- Satin Pillowcases: returns or exchanges accepted within 7 days of delivery, if unused, unwashed and in original packaging.
- Faulty or defective items on any product must be reported within 7 days of delivery, before the item is worn, washed, or altered, with photos and your order number.
Inspection rights: Gracious Nubian reserves the right to physically inspect any item returned as faulty before approving a repair, replacement, or refund. Where inspection shows the fault resulted from wear and tear, incorrect care, misuse, or damage occurring after delivery — rather than a manufacturing defect — the claim will be declined, our findings will be shared with you, and the item will be returned to you. This does not affect your statutory rights under the Consumer Protection Act 68 of 2008.
9. Ownership of Goods
Ownership of goods remains with Gracious Nubian until payment has been received in full. Once full payment is received and goods are delivered, ownership passes to you.
10. Intellectual Property
All designs, branding, product imagery, and content associated with Gracious Nubian remain the property of Gracious Nubian (Pty) Ltd and may not be copied, reproduced, or used without our prior written consent.
11. Limitation of Liability
To the maximum extent permitted by law, our liability for any claim arising from your order is limited to the value of that order. We are not liable for any indirect or consequential loss. Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business or the law. The version of these Terms in effect at the time you place your order will apply to that order.
13. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
